SEE MORE EXPERIENCESThese Special Conditions (hereinafter, Special Conditions) regulate the conditions applicable to the purchase and use of the NUBA EXPEDICIONES S.L. gift card (hereinafter, NUBA Card).
The NUBA Card may be acquired and used by persons of legal age, who have the legal capacity to understand and accept these Special Conditions.
2.1. The NUBA Card is a card personalized by the buyer (hereinafter, Buyer) with the name of a beneficiary, a message and a monetary value for him to redeem it in the NUBA trip of his choice. The NUBA Card is intended for beneficiaries of legal age (hereinafter, Beneficiary) and can be purchased in the following formats:
a) Physical Card, in two different ways of shipment:
– In-store pick-up – The Buyer can pick it up at any NUBA physical store, 24 hours after the online purchase, upon presentation of the purchase confirmation email. There is no deadline for pick up.
– Home delivery – The Beneficiary will receive at the address indicated by the Purchaser the NUBA catalog and the personalized card, where he/she is informed of the available amount that can be redeemed for a NUBA trip. The postal delivery conditions (costs, deadlines and limitations) will be indicated during the purchase process.
b) Electronic Card: The Beneficiary will receive at the e-mail address provided by the Purchaser, an e-mail with a personalized message and the card where he/she is informed of the available amount that can be redeemed for a NUBA trip.
2.2. The NUBA Cards can be redeemed for any of the travel services NUBA has available for contracting. The Beneficiary may use it whenever he/she wants and for the destination he/she chooses. If you do not spend the entire amount given in the Card, the difference in amount may be left as a balance for a second trip or service. If the amount is not enough to satisfy the total value of the trip, the Beneficiary may contribute the difference.
2.3. To redeem the card, the Beneficiary must go to any of the NUBA offices or contact NUBA by phone (+34) 800 088 881 or email marketing@nuba.net . The Beneficiary must show his/her card (physical or electronic) to start designing his/her trip.
The Beneficiary may redeem the NUBA Card to pay for a NUBA service for himself or for third parties, but in any case shall be the only person authorized to request the service.
2.5. NUBA Cards have an expiration date of 2 years from the date of purchase and are not redeemable for cash.
2.6. The services contracted using NUBA Cards are subject to NUBA’s General Terms and Conditions.
3.1. The Purchasers may purchase the NUBA Card through the website www.nuba.com in the section provided for this purpose. After selecting the type of Card (physical or electronic), the Purchaser must; (i) indicate the amount he/she wishes to give as a gift; (ii) write the message that will accompany the Card; (iii) provide the Beneficiary’s data.
3.2. By clicking on “Buy”, the Buyer will be directed to the payment gateway. Once the process is completed, the amount of the contract will be charged through the chosen payment method and the Buyer will receive an email with the receipt of the transaction.
4.1. Buyers shall pay the price corresponding to the amount they have chosen to load on the NUBA Card.
The minimum amount to be charged is €500.00. This price includes VAT and/or any applicable taxes.
Buyers agree to:
a) Provide the information required by NUBA for the contracting. Such information must be true, accurate, complete and updated.
b) Not to use NUBA Cards for commercial or promotional purposes without NUBA’s prior written authorization.
6.1. Buyers who are considered consumers may, in general, exercise the right of withdrawal within a maximum period of 14 calendar days from the date of delivery of the NUBA Card.
6.2. This right shall cease to apply at the time the Beneficiary exchanges the amount of the NUBA Card for any of the NUBA services, the cancellation and/or modification of which is subject to NUBA’s General Terms and Conditions.
6.3. The Buyer may exercise his right of withdrawal by sending an email to marketing@nuba.net , communicating his decision to withdraw unequivocally.
6.4. In the event that a physical NUBA Card has been purchased, the Purchaser must return it, in the original box, within 14 calendar days, by (i) mailing it to NUBA c/Serrano 96, 28006 Madrid or (ii) delivering it to any other NUBA store.
6.5. All costs incurred in returning the physical NUBA Card shall be borne by the Purchaser. Before returning the NUBA Card, the Purchaser must ensure that the pack (card + catalog) is properly protected so that it is not damaged in transit.
6.6. The exercise of the right of withdrawal in accordance with the conditions described in this clause will result in a refund within 14 days from receipt of the physical NUBA Card in perfect condition or from the date of communication of the withdrawal in the case of electronic NUBA Card, using the same means of payment used by the Buyer, unless it has expressly provided otherwise.

The collection and processing of personal data will be carried out subject to the provisions of the Privacy Policy.
NUBA shall be responsible for the performance of its contractual obligations in accordance with the provisions of these Special Conditions.
NUBA may not in any case be held responsible for the information or data of the Beneficiaries provided by the Buyer, nor for delays or errors in the delivery of NUBA Cards that are caused by incorrect or outdated data.
NUBA shall not be liable for any theft or loss of the NUBA Card and reserves the right to deactivate those NUBA Cards that have been fraudulently obtained. In case of loss or theft of the NUBA Card, the Beneficiary must notify NUBA through the channels indicated in Clause 7.
NUBA reserves the right to modify these Special Conditions when necessary for the purpose of adapting to legislative, business and / or technological changes. The updated texts shall be valid and effective upon publication on the NUBA website.
10.2. The temporary validity of these Special Conditions coincides, therefore, with the time of its exposure, until it is totally or partially modified, at which time the updated texts shall become effective.
11.1. The headings of the different clauses are for information purposes only, and shall not affect, qualify or modify the interpretation of the Special Conditions.
11.2. The waiver by NUBA of one or more of the provisions of these Special Conditions shall not be deemed or construed as a waiver thereof.
11.3. The unlawfulness, invalidity or ineffectiveness of any of the clauses of these Special Conditions shall not affect the effectiveness of the rest, provided that the rights and obligations of the parties are not affected in an essential manner. Said clauses shall be replaced or integrated with others that, being in accordance with the law, meet the purpose of the replaced clauses.
11.4. These Special Conditions shall be governed and interpreted in accordance with the provisions of the Spanish legislation applicable to them.
11.5. Buyers resident in the European Union may use the “Online Dispute Resolution Platform” for the out-of-court resolution of any dispute arising from the purchase of NUBA Cards. Buyers can access the platform here: http://ec.europa.eu/consumers/odr/
